1. Acceptance of Terms

By accessing or using Chat Funnel ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users of the Service, including visitors, registered users, and paying subscribers.

2. Description of Service

Chat Funnel is a SaaS platform that enables users to build, embed, and manage lead generation funnels with branching logic. We provide the tools; you are responsible for the content of the funnels you create and the leads you collect.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You must be at least 18 years old to use the Service. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Collect personal data without proper disclosure or consent
• Violate any applicable law, including TCPA, CAN-SPAM, GDPR, or CCPA
• Send spam, unsolicited communications, or misleading content
• Impersonate another person or entity
• Attempt to gain unauthorized access to the platform or other users' data
• Use the Service for any illegal, harmful, or fraudulent purpose

5. TCPA Compliance

If you use Chat Funnel to collect phone numbers or send SMS messages, you are solely responsible for complying with the Telephone Consumer Protection Act (TCPA) and all applicable telemarketing laws. This includes obtaining proper written consent from leads before contacting them. Chat Funnel is not liable for your compliance failures.

6. Subscription and Billing

Paid plans are billed monthly or annually in advance. Subscriptions auto-renew unless cancelled before the renewal date.

All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

Payment processing is handled by Stripe. By subscribing, you agree to Stripe's terms of service.

7. Intellectual Property

Chat Funnel and its original content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You retain ownership of the funnel content and lead data you create through the platform.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for obtaining any required consents from end users before collecting their personal data through your funnels.

9. Uptime and Service Availability

We strive for high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience downtime. We are not liable for losses resulting from service interruptions.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

11. Limitation of Liability

To the maximum extent permitted by law, Chat Funnel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Chat Funnel and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Service, your content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may cancel your account at any time through the account settings.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in binding arbitration, except where prohibited by law.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
